Terms and Conditions – SpaceK

These Terms and Conditions ("Terms") govern your use of the SpaceK platform, including our website, mobile application, and related services (collectively, the "Platform"). SpaceK is a Saudi Arabia-based platform designed to facilitate the booking of venues such as meeting rooms, halls, chalets, and resorts for corporate events and gatherings.

By accessing or using the Platform, you agree to be bound by these Terms, which constitute a legally binding agreement. If you do not agree, please refrain from using the Platform. These Terms form a binding legal agreement between you and SpaceK and govern your right to use SpaceK's website, apps, and other offerings. SpaceK allows users — referred to as "guests" or "clients" — to search for and book services. SpaceK also provides "hosts" or "unit lessors" a way to list venue bookings and provide services. Each host service is referred to as a "Host Listing."

SpaceK does not own, control, offer, or manage any Host Listings or hosting services. The SpaceK website provides service providers with a platform to advertise and lease spaces and other directly related services. Service providers can begin offering meeting venues and packages on the SpaceK services platform after signing a separate service provider agreement with SpaceK.

SpaceK is not the owner or operator of any property or space listed on the platform, and its role is solely to facilitate service provision. SpaceK accepts no liability to you or any other party regarding the information or content in listings, or the legality, safety, or suitability of any space or booking.

The user alone is responsible for completing or accepting any booking, including the following: If any user feels unsafe or uncomfortable with any booking terms, they should immediately refrain from completing the booking and cancel it. You acknowledge and agree that using the services via the platform does not imply that SpaceK is the hosting provider or vendor. Its role is limited to offering booking-related services.

1. General Provisions

1.1 Eligibility:

You must be at least 18 years old and have the legal capacity to enter into contracts to use the Platform. You confirm that your use complies with all applicable local, national, and international laws.

1.2 Platform Access:

SpaceK provides access to the Platform but reserves the right to modify, suspend, or withdraw access without notice, subject to any existing financial obligations. We are not responsible for unavailability due to technical issues or maintenance.

1.3 Amendments:

SpaceK may update these Terms at any time. Changes become effective once published on the Platform. Continued use constitutes acceptance of the updated Terms. No retroactive changes apply to previous bookings. You must review the Terms and Conditions every time you visit the site to stay informed of any updates.

1.4 Personal Use:

The Platform is intended for personal, non-commercial use unless otherwise agreed. You may not resell, copy, or exploit Platform content for commercial purposes without express written consent.

2. Booking Terms

2.1 Booking Process:

When booking through SpaceK, the platform acts as an intermediary, transmitting booking details and confirmations. You agree to abide by the venue's specific terms, including payment schedules, cancellation policies, and usage rules.

2.3 Booking Confirmation:

  • After completing a booking via SpaceK, your request will be reviewed by the relevant venue manager.
  • If accepted, you will receive a confirmation email or SMS with booking details and contact information.
  • The booking is only confirmed and binding upon receiving SpaceK's official confirmation message.
  • If confirmation is not received within 72 hours, the request is automatically canceled without charge, and you will be notified through official channels. SpaceK is not responsible for any obligations or expenses incurred before final confirmation.

2.4 Payment:

  • Full payment is required within 24 hours of booking confirmation.
  • The full booking amount must be paid via SpaceK using approved payment methods (e.g., bank cards or bank transfer).
  • The platform collects the payment on behalf of the host and holds it under the terms agreed with the venue provider.
  • Please review all payment details and venue cancellation policies before finalizing the booking. SpaceK assumes no responsibility for refunds if the host applies a strict cancellation policy.
  • Any remaining balance must be paid at least 30 days before the event.
  • Payments are processed securely via credit/debit cards or bank transfers through third-party payment gateways.
  • SpaceK is not responsible for unauthorized card use. Report fraud to your bank and contact Support@spacek.co.

2.4 Accuracy:

Venue providers are responsible for updating prices, availability, and descriptions. While SpaceK strives for accuracy, it does not guarantee it and is not liable for errors (e.g., typos) or service interruptions. If some requested facilities are not available upon arrival, you are advised to file a complaint directly with the accommodation provider. The application and website do not guarantee availability of any pre-requested facilities. The venue provider bears full responsibility for all submitted data (e.g., payment details, photos and videos of the venue, descriptions, and location). SpaceK disclaims all responsibility for data provided to it.

3. Security Deposit

If a host requires a security deposit, the guest must pay it upon arrival and before receiving the reserved unit, as per the host's conditions. If the unit is returned in good condition, the host must return the deposit after verification and before the arrival of the next guest. The host may retain the deposit in case of damages.

4. Cancellation & No-Show Policies

4.1 Venue Policies:

Cancellation and no-show policies vary by venue and are stated during booking and in confirmation messages. Options may include:

  • Strict: Non-refundable after confirmation.
  • Moderate: Full refund if canceled at least 4 days before the event.
  • Flexible: Full refund if canceled at least 2 days before the event.
  • Free: Full refund if canceled before check-in (11:59 PM local time).

Some venues may apply extra charges for early arrival.

4.2 User Responsibilities:

  • To cancel or modify a booking, follow instructions in your confirmation message or email info@spacek.co.
  • Late cancellations or no-shows may lead to loss of payment, per venue policy.
  • Inform the venue directly about late arrival to avoid cancellation.

4.3 SpaceK Fees:

SpaceK may charge additional fees for cancellations or changes, as shown during booking.

Note: Users are responsible for reviewing the venue's cancellation and no-show policies before completing the booking.

5. Acceptable Use

5.1 Permitted Use:

The Platform may be used only for lawful purposes, such as legitimate bookings or checking availability. You agree to:

  • Provide accurate information during registration and booking.
  • Notify others if booking on their behalf under applicable terms.
  • Avoid speculative or fake bookings.

5.2 Prohibited Use:

You may not:

  • Violate any local or international laws.
  • Upload defamatory, abusive, illegal, or harmful content or viruses.
  • Interfere with the Platform's functionality or overload its infrastructure.
  • Copy or distribute content without permission.
  • Attempt unauthorized access to accounts or data.
  • Use or access the Platform if you're a direct or indirect competitor of SpaceK or sharing content with one.

5.3 Violations:

SpaceK reserves the right to:

  • Warn or delete violating content.
  • Suspend or restrict access.
  • Cancel bookings without notice.
  • Report actions to authorities or ISPs.
  • Take legal action.

6. Personal Data Protection

6.1 Data Collection:

SpaceK collects only essential data (e.g., name, phone number, email, payment info) for booking processing, service improvement, and communication. Data is collected directly via registration/booking or automatically (e.g., cookies) or from partners under Saudi personal data protection regulations.

6.2 Data Usage:

Your data is used for:

  • Completing bookings and payment processing.
  • Customizing user experience and improving services.
  • Sending notifications about bookings, offers, or updates (with your consent).
  • Legal compliance.

6.3 User Rights:

  • Access, correct, or request deletion of your data via support@spacek.co.
  • Withdraw consent to data processing anytime unless legally required.
  • Receive a copy of your data within 14 business days.

6.5 Cookies:

We use cookies to enhance user experience and analyze performance. You may manage preferences through Platform settings.

7. Security

7.1 Measures:

We use advanced security technologies (e.g., encryption, firewalls) to protect your data from unauthorized access or loss.

7.2 Your Responsibility:

You are responsible for protecting your password and device. Do not send card details via unencrypted channels. We may require ID verification before disclosing your data.

8. Intellectual Property Rights

8.1 Ownership:

All Platform content (e.g., text, images, logos) is owned by SpaceK or its licensors and is protected by copyright and trademark law.

8.2 Use:

You may not copy, modify, or distribute Platform content without prior written permission. Use of the Platform does not grant you any ownership rights.

9. Communication & Complaints

9.1 Contact:

By completing a booking, you agree to receive booking confirmations or service notifications via email or SMS.

9.2 Complaints:

To file a complaint, contact support@spacek.co. We will attempt to resolve issues, but venue-related complaints (e.g., decor or services) must be addressed directly with the venue provider. We cannot guarantee satisfactory outcomes for third-party complaints.

9.3 Support:

We strive to ensure 24/7 service access, but we are not responsible for temporary unavailability due to maintenance or outages. Support content is provided to help you use the platform, but we do not guarantee its accuracy or updates. Customer experience team support is available, but response times are not guaranteed.

10. Limitation of Liability

10.1 Intermediary Role:

SpaceK acts solely as an intermediary between you and venue providers. We are not liable for venue errors, service interruptions, or damages resulting from Platform use.

10.2 Disclaimer:

To the fullest extent permitted by law, SpaceK is not liable for direct or indirect damages (e.g., lost profits or data) arising from Platform use or inability to use it.

11. Indemnification

11.1 Your Obligation:

You agree to indemnify SpaceK for any losses or claims arising from illegal use of the Platform or violations of these Terms. SpaceK is not liable for indirect or consequential damages, and its maximum liability is subject to its discretion.

12. External Links

12.1 Third-Party Sites:

The Platform may contain links to external websites. SpaceK is not responsible for their content or policies. Be cautious when redirected to external sites and review their privacy policies.

13. General Provisions

13.1 Legal Compliance:

If any clause conflicts with Saudi law, that clause is void, and the rest remain valid.

13.2 User Registration:

If you use another person's data without their consent, you bear full responsibility for any damages.

13.3 Disputes:

In the event of a dispute between you and a venue provider, your data may be shared with the other party or legal authorities as required by law.
